Acceptance of Terms: By accessing, enrolling in, or using any part of the Higherful online education platform (“Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Platform. platform.

 

Course Enrollment & Eligibility:

Enrollment in courses is subject to availability and may require payment of applicable fees. Higherful reserves the right to:

  • Modify, update, or discontinue any course

  • Adjust pricing

  • Limit availability to certain users or geographic regions

You are responsible for ensuring that you meet any prerequisites required by certifying bodies (e.g., NASM, AFAA, ACE).

 

Payment, Refunds & Billing Policy:

  • Payment must be made in full at the time of enrollment unless otherwise explicitly stated.

  • Refunds may be available only in accordance with our Refund Policy, which is incorporated into these Terms.

  • Refunds are not available once a course has been completed, accessed, downloaded, or if a certificate has been issued.

  • Higherful reserves the right to refuse refunds if there is evidence of course misuse or abuse of the refund system.

  • All prices listed are subject to change without notice.

Course Access & License of Use:

Upon purchase, you will receive access to course materials for the period stated on the course page.
Unless explicitly stated:

  • Access is granted for individual personal use only

  • Sharing login credentials, downloading materials for redistribution, or providing access to others is strictly prohibited

  • Higherful may revoke access without refund if unauthorized use is detected

Higherful may update or modify course content at any time to maintain educational accuracy and quality.

 

Intellectual Property Rights:

All course materials—including videos, graphics, PDFs, quizzes, written content, and certificates—are the property of Higherful and are protected by copyright, trademark, and intellectual property laws.
You may not:

  • Copy

  • Reproduce

  • Modify

  • Redistribute

  • Resell
    any course content without express written permission from Higherful.

Violation may result in immediate revocation of course access and potential legal action.

 

Continuing Education Credits (CECs/CEUs): 

Certain courses may qualify for CE credit through partnering organizations such as NASM, AFAA, ACE, or others. Higherful does not guarantee acceptance of CE credits by all organizations.
You are responsible for:

  • Verifying eligibility with your certifying organization

  • Submitting documentation as required

  • Understanding expiration dates or recertification timelines

Higherful is not responsible for CE credits being rejected due to user ineligibility or certification body policy changes.

 

User Conduct:

You agree not to:

  • Violate any local, state, federal, or international law

  • Interfere with the Platform’s functionality or security

  • Attempt to access restricted areas of the site

  • Use the Platform for fraudulent or deceptive activity

  • Harass, threaten, or disrupt the learning experience for other users

Higherful may suspend or terminate your account for violations without refund.

 

Privacy Policy: Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Platform, you consent to these practices.

Higherful’s total liability shall not exceed the amount paid for the course giving rise to the claim.

 

Governing Law & Dispute Resolution: These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute shall be resolved exclusively in the state or federal courts located in Broward County, Florida.

By using our platform, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These terms may be updated or amended from time to time, and it is your responsibility to review them periodically for any changes.

 

Modifications to Terms:

Higherful reserves the right to update or modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Platform constitutes acceptance of the updated Terms.
